DeFiThena Terms of Use

These Terms of Use ("Terms") govern your access to and use of the DeFiThena Google Sheets extension ("Extension"), provided by DeFiThena ("we," "us," or "our"). The Extension is a tool that allows users to pull blockchain data into Google Sheets using custom functions. By installing, accessing, or using the Extension, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the Extension.
1. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use the Extension. By using the Extension, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
2. Description of the Extension
DeFiThena provides custom functions within Google Sheets to retrieve and display blockchain-related data, such as cryptocurrency prices, transaction details, and other DeFi metrics. The data is sourced from third-party blockchain APIs and services. We do not guarantee the accuracy, completeness, or timeliness of the data provided, as it relies on external sources that may be subject to delays, errors, or changes.
The Extension integrates with Google Sheets and is subject to Google's Terms of Service and Privacy Policy. You must comply with all applicable Google policies when using the Extension.
3. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Extension for your personal or internal business purposes. You may not:
Modify, reverse engineer, decompile, or disassemble the Extension.
Distribute, sell, rent, lease, or sublicense the Extension.
Use the Extension for any illegal or unauthorized purpose.
4. User Responsibilities
Account Security: If the Extension requires integration with your Google account or other services, you are responsible for maintaining the security of your accounts and any API keys or credentials used.
Compliance: You agree to use the Extension in compliance with all applicable laws, including those related to data privacy, financial regulations, and blockchain technologies.
Data Usage: Blockchain data may involve financial risks. You are solely responsible for any decisions made based on data retrieved via the Extension, including investment or trading activities.
Prohibited Conduct: You may not use the Extension to:
Transmit harmful code, viruses, or malware.
Engage in spamming, phishing, or other abusive activities.
Violate the rights of third parties, including intellectual property rights.
Overload or disrupt the Extension or its underlying services.
5. Intellectual Property
We own all rights, title, and interest in the Extension, including its code, design, and any custom functions. All blockchain data retrieved is owned by the respective blockchain networks or third-party providers. By using the Extension, you grant us a non-exclusive, royalty-free license to use any feedback or suggestions you provide for improving the Extension.
6. Privacy and Data Collection
The Extension may collect limited usage data, such as function calls and error logs, to improve performance and troubleshoot issues. We do not collect personal financial data unless explicitly provided by you. For details on how we handle data, please refer to our Privacy Policy. By using the Extension, you consent to such data collection.
Note: The Extension pulls data from third-party blockchain sources, which may have their own privacy practices. We are not responsible for the privacy policies of these third parties.
7. Disclaimers
THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT:
The Extension will be uninterrupted, error-free, or secure.
Blockchain data will be accurate, reliable, or up-to-date.
The Extension will meet your specific requirements.
Blockchain and DeFi technologies are inherently volatile and risky. We disclaim any responsibility for losses arising from market fluctuations, data inaccuracies, or third-party service failures.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE EXTENSION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE EXTENSION, IF ANY.
9. Indemnification
You agree to indemnify, defend, and hold us harmless from any claims, losses, or damages arising from your misuse of the Extension, violation of these Terms, or infringement of third-party rights.
10. Termination
We may terminate or suspend your access to the Extension at any time, without notice, for any reason, including violation of these Terms. Upon termination, your license to use the Extension ends, and you must uninstall it.
11. Changes to the Terms
We reserve the right to modify these Terms at any time. We will notify you of changes by updating the "Last Updated" date. Your continued use of the Extension after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by the laws of Georgia, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Georgia.
